Trading in your state/territory

New South Wales

The Water Management Act 2000 (NSW) provides the legislative framework for water transactions in NSW. The Water Management Act replaces the Water Act 1912 (NSW) . However the Water Act 1912 (NSW) is still in force in catchments where Water Sharing Plans have not been finalised. Water trades in these catchments will come under the Water Management Act 2000 with the completion and implementation of Water Sharing Plans.

To give effect to a water trade in New South Wales several administrative measures and processes are required. The process required depends on the water trade type and the Trade Approval Authority involved.

There are three key organisations involved in the trading processes in New South Wales . The broad responsibilities of these organisations are outlined below:

  • Office of Water:
    • Licence transactions
    • Licence compliance activities
    • Works approvals transactions
    • Site use approvals transactions
    • Issue of approval
    • Public visibility of approvals
  • State Water
    • Bulk water infrastructure management
    • Delivery of allocated water
    • Meter reading
    • Water account management
    • Available water determination (water allocation)
    • Manage allocation transfers
    • Public visibility of water resource allocations
  • Land and Property Management Authority
    • Licence (entitlement) transfers
    • Registration and issue of licence certificates
    • Identification and recording of security interests and caveats
    • Public visibility of water access licences

Intrastate trade

Trades and transfers of water access licences must be registered on the Water Access Licence (WAL) Register by Land and Property Information (LPI) to take effect.

For trades relating to allocations, applications are made to the State Water Corporation.

For trades relating to water access licences, applications are made to the Office of Water . The customer will be notified by the appropriate agency of the outcome of the application.

Interstate Trade

When completing an interstate allocation trade the customer must complete the appropriate forms for both of the jurisdictions involved. Jurisdictions will notify the Murray-Darling Basin Authority with details of each allocation trade undertaken.
